1. About These Terms

These Terms and Conditions (“Terms”) govern your use of the SOHL Studio by Roz online platform, including the website, mobile application, and all associated content and services (collectively, the “Platform”). The Platform is operated by SOHL Studio by Roz (“we”, “us”, “our”).

By creating an account, subscribing to a plan, or using the Platform in any way, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

We may update these Terms from time to time. If we make material changes, we will notify you via email or through the Platform. Your continued use of the Platform after changes are posted constitutes acceptance of the updated Terms.

2. Eligibility

You must be at least 18 years of age to create an account and use the Platform. By registering, you confirm that the information you provide is accurate and that you are legally able to enter into a binding agreement.

3. Account Registration

To access the Platform, you must create an account with a valid email address and password. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised use.

You may not share your account credentials with others. Each subscription is for individual, personal use only. We reserve the right to suspend or terminate accounts that we reasonably believe are being shared or misused.

4. Subscriptions and Pricing

4.1 Plans

We offer the following subscription plans:

  • Monthly Plan: AUD $29.95 per month
  • Yearly Plan: AUD $280.00 per year

All prices are in Australian Dollars (AUD) and include GST where applicable.

4.2 Free Trial

New subscribers may be eligible for a 7-day free trial. During the trial period, you will have full access to the Platform at no charge. If you do not cancel before the trial ends, your selected subscription plan will automatically begin, and your payment method will be charged.

You are only eligible for one free trial per person. We reserve the right to determine eligibility and to withdraw the free trial offer at any time.

4.3 Billing

Subscriptions are billed in advance on a recurring basis (monthly or yearly, depending on your plan). Your payment method will be automatically charged at the start of each billing cycle.

4.4 Price Changes

We may change our subscription prices from time to time. If we increase the price of your plan, we will give you at least 30 days’ notice before the change takes effect. You may cancel your subscription before the new price applies.

5. Cancellation and Refunds

5.1 Cancellation

You may cancel your subscription at any time through your account settings or by contacting us. Upon cancellation:

  • Your access to the Platform will continue until the end of your current billing period.
  • No further charges will be made after the current period ends.
  • Cancellation does not entitle you to a refund for the current billing period.

5.2 Refunds

Subscription fees are generally non-refundable. However, we comply with the Australian Consumer Law (“ACL”). If you believe you are entitled to a refund under the ACL — for example, because the Platform was not provided with due care and skill, or was not fit for a particular purpose — please contact us and we will assess your request in accordance with our legal obligations.

5.3 Cooling-Off Period

If you are a consumer under Australian law, you may have the right to a refund if you cancel within a reasonable period and have not accessed or used the content. This does not apply to free trials that have converted to paid subscriptions.

6. Use of the Platform

6.1 Permitted Use

Your subscription grants you a personal, non-exclusive, non-transferable, revocable licence to access and stream content on the Platform for your own private, non-commercial use.

6.2 Restrictions

You must not:

  • Share, distribute, or make available any content from the Platform to any third party.
  • Download, record, screenshot, or copy any content from the Platform unless expressly permitted.
  • Use the Platform for any commercial, public performance, or broadcast purpose.
  • Reverse-engineer, modify, or create derivative works based on the Platform or its content.
  • Use automated tools, bots, or scrapers to access the Platform.
  • Circumvent or attempt to circumvent any access controls, digital rights management, or security measures.

6.3 Fair Use

We monitor usage to ensure fair access for all subscribers. We reserve the right to suspend or terminate accounts that demonstrate unusual or excessive usage patterns that suggest account sharing, automated access, or commercial use.

7. Content and Intellectual Property

7.1 Ownership

All content on the Platform — including but not limited to video classes, audio, images, text, graphics, logos, trademarks, and software — is owned by or licensed to SOHL Studio by Roz and is protected by Australian and international copyright, trademark, and intellectual property laws.

7.2 No Transfer of Rights

Your subscription does not grant you any ownership rights in the content. You may not reproduce, distribute, publicly display, or create derivative works from any content on the Platform without our prior written consent.

7.3 User Content

If you submit any content to the Platform (such as reviews, comments, or feedback), you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, modify, and display that content in connection with the Platform and our business.

8. Health and Safety Disclaimer

8.1 Not Medical Advice

The content on the Platform is for general educational and fitness purposes only. It is not intended to be a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your doctor or qualified health provider before starting any new exercise program or if you have any concerns about your health.

8.2 Assumption of Risk

Exercise involves inherent risks, including the risk of injury. By using the Platform, you acknowledge that you participate in all activities at your own risk. You are responsible for exercising within your own limits and abilities.

You should stop exercising immediately if you feel pain, dizziness, shortness of breath, or any other discomfort, and seek medical attention if necessary.

8.3 Equipment

Some classes require specific equipment such as a Reformer, Wunda Chair, or Tower. You are responsible for ensuring that your equipment is in safe working condition and that you are trained in its proper use. We are not responsible for injuries resulting from faulty, improperly maintained, or incorrectly used equipment.

8.4 Pre-Existing Conditions

If you are pregnant, postnatal, have a pre-existing medical condition, or are recovering from injury, you should consult your healthcare provider before participating in any classes on the Platform. While we offer classes labelled for specific populations, these are general in nature and may not be appropriate for your individual circumstances.

9. Limitation of Liability

To the maximum extent permitted by law, SOHL Studio by Roz, its owners, employees, instructors, and affiliates will not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages.
  • Any loss of profits, data, goodwill, or other intangible losses.
  • Any injury, illness, or physical harm arising from your use of the Platform or participation in any exercise or activity shown on the Platform.
  • Any interruption, suspension, or termination of the Platform or its content.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law or any other applicable law that cannot be excluded, restricted, or modified by agreement.

Where our liability cannot be excluded, our total liability to you for all claims is limited to the amount you paid for your subscription in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless SOHL Studio by Roz, its owners, employees, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from:

  • Your use of the Platform.
  • Your breach of these Terms.
  • Your violation of any law or the rights of any third party.

11. Third-Party Services

The Platform may contain links to third-party websites, services, or content (including our streaming platform provider). We do not endorse or assume responsibility for any third-party content, products, or services. Your use of third-party services is at your own risk and subject to their own terms and conditions.

12. Privacy

Your privacy is important to us. Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which forms part of these Terms. By using the Platform, you consent to our handling of your personal information in accordance with our Privacy Policy and the Privacy Act 1988 (Cth).

13. Suspension and Termination

We reserve the right to suspend or terminate your account and access to the Platform at any time, with or without notice, if:

  • You breach any of these Terms.
  • We reasonably believe your account is being shared or misused.
  • We are required to do so by law.
  • We discontinue the Platform or any part of it.

If we terminate your account due to a breach of these Terms, you will not be entitled to a refund. If we discontinue the Platform, we will provide a pro-rata refund for any unused portion of your subscription.

14. Force Majeure

We will not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, war, pandemic, government action, power failure, internet disruption, or third-party service provider outages.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales and any courts of appeal from them.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SOHL Studio by Roz regarding your use of the Platform. They supersede all prior agreements, representations, and understandings.

SOHL Studio Pilates offers the following services:
Online membership platform — Pilates, yoga, mobility, strength classes and mentorship/pro programs via Uscreen
Pilates teacher training programs delivered in partnership with Pilates Education Australia
Retreats and in-person events
Equipment specialist training courses

20.Teacher Training — Enrolment and Payment

3.1 Enrolment is binding once a deposit has been paid and confirmed.
3.2 A 30% non-refundable, non-transferable deposit is required to secure your place in any teacher training program. The remaining balance is due before your first live session or module access date.
3.3 Course commencement is defined as your first log on to the online learning platform. No refund will be given once portal access has been granted, regardless of whether any content has been accessed.
3.4 Deposits are non-refundable and non-transferable under any circumstances, including but not limited to change of mind, personal circumstances, injury, or illness.
3.5 Deferral fees apply as follows:
3.6 Missed payments may result in suspended platform access and withheld certification until the outstanding balance is paid in full.
3.7 SOHL Studio Pilates and Pilates Education Australia reserve the right to postpone or reschedule modules if minimum enrolment numbers are not met. Students will be notified with a minimum of 14 days notice and offered a transfer to the next available intake.
3.8 Certifications are issued through Pilates Education Australia upon successful completion of all required assessments, hours, and payment obligations.
3.9 Your contact details will be shared with Pilates Education Australia for the purpose of online learning platform access and certification administration.
$50 AUD per module for deferral requests made more than 7 days before commencement
$250 AUD per module for deferral requests made less than 7 days before commencement
No deferral is available once a module has commenced

21.Online Platform Membership

4.1 Platform membership terms, cancellation policy, and billing are governed by the Uscreen terms of service, which are provided at the point of purchase and available on the platform.
4.2 SOHL Studio Pilates reserves the right to update, modify, or remove platform content at any time without notice.
4.3 Membership access is for personal use only and may not be shared, transferred, or used for commercial purposes without prior written consent from SOHL Studio Pilates.

22.Intellectual Property

5.1 All content on the SOHL Studio Pilates website and online platform — including but not limited to videos, programs, class sequences, written materials, graphics, logos, brand assets, and teaching methodology — is the intellectual property of SOHL Studio Pilates unless otherwise stated.
5.2 Content produced in partnership with Pilates Education Australia remains the intellectual property of Pilates Education Australia and is used by SOHL Studio Pilates under licence. This includes but is not limited to course manuals, curriculum materials, and assessment documents.
5.3 You may not reproduce, distribute, modify, publish, transmit, or create derivative works from any content owned by SOHL Studio Pilates or Pilates Education Australia without prior written permission.
5.4 Unauthorised use of any intellectual property may result in legal action.
5.5 Students enrolled in teacher training programs may use course materials for personal study and professional development purposes only. Course materials may not be shared, reproduced, or used to create competing products or programs.
These Terms and Conditions apply to all services unless otherwise stated. Additional terms specific to teacher training enrolments are outlined in the Student Enrolment Form and must be read in conjunction with these Term

23.Health and Medical Disclaimer

6.1 Pilates and movement-based exercise involves physical activity that carries inherent risk. By participating in any class, program, training, or retreat offered by SOHL Studio Pilates, you acknowledge and accept this risk.
6.2 You confirm that you are in adequate physical health to participate in exercise and movement programs. If you have any medical condition, injury, illness, or are pregnant, you agree to consult a qualified medical professional before commencing any program.
6.3 SOHL Studio Pilates instructors are qualified movement professionals but are not medical practitioners. Nothing provided through our website, platform, or programs constitutes medical advice, diagnosis, or treatment.
6.4 SOHL Studio Pilates accepts no liability for any injury, illness, loss, or damage — direct or indirect — arising from participation in any program, class, retreat, or training offered by SOHL Studio Pilates.
6.5 It is your responsibility to inform your instructor of any injuries, medical conditions, or physical limitations prior to participation. SOHL Studio Pilates reserves the right to exclude any participant from a program if, in the reasonable opinion of the instructor, participation poses a risk to that person or others.

24.Photography and Video Consent

7.1 SOHL Studio Pilates may photograph or record video during face to face training days, retreats, and events for the purpose of marketing, social media, education, and promotional materials.
7.2 By attending any face to face training day, retreat, or event run by SOHL Studio Pilates, you consent to being photographed or filmed and to the use of such images or footage by SOHL Studio Pilates across digital and print platforms including but not limited to Instagram, Facebook, YouTube, and the SOHL Studio Pilates website.
7.3 If you do not wish to be photographed or filmed, you must notify SOHL Studio Pilates in writing prior to the event. We will make reasonable efforts to accommodate your request, however we cannot guarantee exclusion from all incidental photography or footage.
7.4 SOHL Studio Pilates will not sell images or footage of participants to third parties.
7.5 You retain no rights to images or footage captured by SOHL Studio Pilates at its events.
Privacy
8.1 SOHL Studio Pilates collects personal information for the purpose of delivering services, administering enrolments, processing payments, and communicating with clients and students.
8.2 Your personal information will not be sold to third parties. It may be shared with service providers necessary to deliver our services — including Pilates Education Australia, payment processors, and email marketing platforms — in accordance with Australian

25.Privacy Law.

8.3 By submitting your details through any form on our website or platform, you consent to being contacted by SOHL Studio Pilates regarding your enquiry, enrolment, or purchase.
8.4 You may unsubscribe from marketing communications at any time by clicking the unsubscribe link in any email or by contacting us directly.

10.2 Where liability cannot be excluded under Australian Consumer Law, SOHL Studio Pilates limits its liability to the resupply of the relevant service or the cost of having the service supplied again.
